Warranty Terms

Product Warranty

Industrial Metal Service warrants that materials and goods manufactured by us will be free from defects in material and workmanship for ninety (90) days following the date of shipment.

THE FOREGOING WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE NOT EXPRESSLY SET FORTH HEREIN, ARE HEREBY EXCLUDED.

Important Warranty Limitations

Third-Party Products: Goods that may be sold by Industrial Metal Service but which are not manufactured by us are not warranted by Industrial Metal Service, but are sold only with the warranties, if any, of the manufacturers thereof.

Warranty Exclusions: Our warranty does not apply to any goods which have been subjected to:

• Misuse, mishandling, or misapplication
• Neglect or accident
• Improper installation or modification
• Use of unauthorized parts or attachments

Warranty Claims Process

How to Submit a Warranty Claim

All warranty claims must be submitted in writing to Industrial Metal Service within the earlier of:

1. 30 days following the date you discovered, or by reasonable inspection should have discovered, any claimed breach of warranty, OR
2. 90 days following the date of shipment

Our Warranty Response

If goods are found by Industrial Metal Service to be defective, we will, at our option:

• Replace the defective goods at our cost
• Repair the defective goods at our cost
• Refund the purchase price
• Provide a reasonable allowance

This exclusive remedy shall be your sole recourse against Industrial Metal Service for defective goods.

Time Limit for Legal Action

Any legal action for breach of warranty must be brought within one year from the date the alleged breach was discovered or should have been discovered, whichever occurs first.

Inspection and Acceptance

Upon receipt of shipment, you must immediately inspect the goods. Unless you provide Industrial Metal Service with written notice of any claims, shortages, or defects within 48 hours after receipt of shipment, such goods shall be deemed finally inspected, checked, and accepted.

Limitation of Liability

INDUSTRIAL METAL SERVICE’S LIABILITY FOR ITS GOODS SHALL BE LIMITED TO REPAIRING, REPLACING, OR REFUNDING THE PURCHASE PRICE OF NON-CONFORMING GOODS.

Disclaimer of Consequential Damages

IN NO EVENT SHALL INDUSTRIAL METAL SERVICE BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, including without limitation:

• Loss of use, income, or profit
• Losses sustained as the result of injury to any person
• Loss of or damage to property
